NEW DELHI: The Delhi Development Authority (DDA) has challenged Rera‘s move to mandate registration of its residential and commercial projects in the national capital, the chief of Delhi’s real estate regulator has said.
The development may set the stage for a confrontation as Rera chairman Anand Kumar said that any player who is into real estate development – whether a development authority like DDA or Delhi State Industrial and Infrastructure Development Corporation Ltd (DSIDC) – must get registered with the regulatory body.
“The law requires all real estate projects, including that of the government agency DDA, spread over more than 500 square metres or if the number of units on any plot is eight or more to be registered,” Kumar said.
During an interactive session organised by CII-Delhi on Tuesday evening, Kumar said the law empowers the regulator to act against those who fail to do so. “We have given orders asking DDA to register with us… DDA has challenged it before the appellate authority. The development authorities must own it up, own up their responsibilities,” Kumar told TOI.
DDA, which also comes under direct control of the Centre, has challenged the provision in Rera, which makes it mandatory for all real estate developers, including government authorities, to register their projects for sale with the respective regulators in the state.
The developments in Delhi could also set a precedent for other states, where government agencies may not be registering their projects with Rera.
Kumar said, “DDA or any development authority is going to sell the flats or commercial units after completing them. The Rera has the prime objective to protect the interest of buyers. After all, the DDA or any other government entity is utilising public funds to take up such projects. Another important aspect is transparency and efficiency. Under Rera, the developer or builder who hands over a building or apartment, is responsible to maintain the quality for five years.”
