TCS Employee News: Techie gets justice after seven years, TCS to pay the full salary

The Chennai Labour court has ruled in favour of Thiruvamalai Selvan who was sacked by () in 2015 allegedly as part of mass retrenchment.

Selvan joined TCS as an IT professional in the position of assistant engineer. Since he was sacked he has been working as a software consultant and real state brokerage to sustain himself.

The court has directed TCS to reinstate Selvan and pay him his salary and benefits of seven years in full.

Selvan told the media that in the process to get justice he had to visit the court more than 100 times. The Forum for IT Employees (FITE), an organisation working for the welfare and rights of the employees, supported him in his legal ordeals.

“Justices anywhere is a hope everywhere & reminder to all who are forcing employees to resign”, FITE tweeted in the support of Selvan.

When Selvan first approached the court seeking continuity of service, the TCS legal representative informed the court that the petitioner didn’t fall under the category of ‘workman’ and even alleged him of performing poorly in his work.

The legal representative of the company also said that he was in a ‘managerial capacity’.
